Key Organisational Requirements

The applicant must be the relevant LA or FRA; the funding must be for third-party expert advice to pursue a legal claim; the regulator must have independently decided to pursue the case based on previous assessment or enforcement work; and the building must meet the fund's safety, location, size and residential criteria. Building Eligibility

The building must contain at least one defect that puts people's safety at risk from the spread of fire; be in England; be a self-contained building or self-contained part of a building containing at least 2 dwellings; and be at least 11 metres or 5 storeys high. A single case may cover multiple buildings, but at least one building must meet these criteria. (Find a Grant)

Additional Requirement for LAs Receiving New Burdens Funding

Where an LA already receives New Burdens funding from MHCLG, initial enforcement action, such as serving an Improvement Notice, must already have been taken in relation to the building safety defects and must not have been complied with. (Find a Grant)

Requirements for Remediation Order / Remediation Contribution Order Cases

For an RO or RCO case, the building must contain at least one relevant defect and the proposed respondent must meet the relevant definitions under the Building Safety Act 2022. For an RCO, the respondent may need to be a specified body corporate under the Act. (Find a Grant)

Option Structure

The two options are assessed and applied for separately. Applicants do not need to have used Option 1 before applying for Option 2. (Find a Grant)

Option 1 Application

Applicants seeking the £5,000 initial legal assessment should use the Option 1 application form.

Option 2 Application

Applicants seeking up to £100,000 for expert services to pursue a legal case should use the Option 2 application form.

Appeals

If an application is unsuccessful and the regulator believes the case meets all gateway criteria, it can request a review within 14 days of receiving the outcome. MHCLG aims to respond to an appeal within 14 days. (GOV.UK)

Objectives

To increase the pace of remediation of unsafe buildings by supporting LAs and FRAs that want to use their legal powers against building owners or other parties that are not progressing remediation quickly enough. (Find a Grant)

Wider Benefits

The fund is intended to benefit leaseholders and residents by reducing the cost burden of interim safety measures, reducing risks to life and wellbeing and reducing uncertainty. It is also intended to build enforcement experience and encourage building owners to remediate proactively. (Find a Grant)

Important Notes

The fund is currently open. Option 1 and Option 2 are separate and an applicant does not have to use Option 1 before applying for Option 2. Funding is for new third-party expert activity, not legal advice already received and paid for.
